KRAFTED DESIGNS KY LLC is a Kentucky limited liability company offering arts, crafts, handmade products, custom-made products, personalized merchandise, and related goods.

Many of our products are handmade, individually produced, personalized, or custom-made. As a result, products may naturally vary from one item to another.

By placing an order with KRAFTED DESIGNS, you represent that:

• You are legally capable of entering into a binding agreement;
• The information you provide is accurate and complete;
• You have authorization to use the payment method provided;
• You are purchasing products for lawful purposes; and
• You will comply with these Terms and all applicable laws.

If you are purchasing on behalf of another person, business, organization, or entity, you represent that you have authority to do so.

We make reasonable efforts to accurately describe and display our products.

However, product photographs, colors, dimensions, textures, finishes, materials, and other characteristics may appear differently depending on:

• Your device;
• Your screen settings;
• Lighting;
• Photography conditions;
• Manufacturing materials;
• Handmade production processes; and
• Natural variations in materials.

Images shown on our website are intended to provide a general representation of a product and may not be an exact representation of the specific item you receive.

We reserve the right to correct typographical, photographic, pricing, inventory, or product-description errors.

Many products sold by KRAFTED DESIGNS are handmade or custom-made.

You acknowledge and agree that handmade and custom products may contain variations in:

• Color;
• Shade;
• Pattern;
• Texture;
• Shape;
• Finish;
• Grain;
• Placement of design elements;
• Dimensions;
• Materials;
• Small imperfections;
• Appearance; and
• Other characteristics.

These variations may result from the handmade nature of the product, materials used, manufacturing processes, lighting, dye lots, paint batches, fabric batches, or other factors.

A reasonable variation from a product photograph, previous order, sample, or digital representation does not automatically constitute a defect.

Custom orders are products created or modified according to information, specifications, selections, or instructions provided by the customer.

Before placing a custom order, you are responsible for carefully reviewing:

• Names;
• Spelling;
• Dates;
• Initials;
• Numbers;
• Colors;
• Sizes;
• Designs;
• Images;
• Personalization;
• Quantities;
• Other customization selections; and
• Any other information submitted with the order.

Once production of a custom order has begun, changes may not be possible.

KRAFTED DESIGNS is not responsible for customer-provided errors, including incorrect spelling, incorrect dates, incorrect measurements, incorrect selections, or incorrect customization instructions.

Customers may submit photographs, artwork, logos, graphics, designs, text, or other materials for use in custom orders.

By submitting such material, you represent and warrant that:

• You own the material or have sufficient permission to use it;
• Your submission does not infringe another person's intellectual-property rights;
• You have permission to reproduce and modify the material for your requested order;
• The material does not violate applicable law; and
• Your submission does not contain unlawful or fraudulent material.

You grant KRAFTED DESIGNS a limited, non-exclusive license to use, reproduce, modify, resize, print, manufacture, and otherwise process submitted material solely as reasonably necessary to complete your order and provide related services.

We reserve the right to refuse a custom order if we reasonably believe the requested material infringes intellectual-property rights, violates applicable law, contains prohibited content, or creates an unreasonable legal or business risk.

Unless otherwise stated, the website, business name, logos, branding, photographs, graphics, product designs, original artwork, written content, descriptions, and other materials created by KRAFTED DESIGNS are owned by or licensed to KRAFTED DESIGNS KY LLC and are protected by applicable intellectual-property laws.

You may not reproduce, copy, distribute, modify, sell, publish, commercially exploit, or create derivative works from our protected materials without prior written permission.

Purchasing a physical product does not automatically transfer ownership of any intellectual-property rights associated with the design, artwork, branding, photographs, or underlying creative work.

You retain ownership of intellectual property that you lawfully own and submit to us.

Nothing in these Terms transfers ownership of your pre-existing intellectual property to KRAFTED DESIGNS.

However, you grant KRAFTED DESIGNS the limited rights reasonably necessary to manufacture and fulfill your order.

We do not claim ownership of your photographs, logos, artwork, or other customer-owned materials merely because you submit them for an order.

KRAFTED DESIGNS reserves the right to refuse, cancel, or decline any order, including custom orders, at our discretion and to the extent permitted by law.

Reasons may include:

• Suspected fraud;
• Payment problems;
• Inventory or material shortages;
• Pricing or listing errors;
• Inability to fulfill requested specifications;
• Intellectual-property concerns;
• Illegal or prohibited content;
• Abusive or threatening behavior;
• Excessive chargeback activity;
• Technical errors; or
• Other legitimate business reasons.

If we cancel an order before fulfillment, we will generally refund amounts actually paid for the canceled order, subject to applicable law.

All prices displayed on our website are subject to change without notice.

Prices may change due to:

• Material costs;
• Supplier pricing;
• Product changes;
• Promotions;
• Errors;
• Taxes;
• Shipping costs; or
• Other business considerations.

The price charged at checkout is the applicable purchase price unless an obvious pricing or technical error occurred.

Applicable sales taxes may be added to purchases as required by law.

The amount of tax charged may depend on the shipping address, applicable state or local laws, and the products purchased.

Payment must be successfully authorized before an order enters production or fulfillment.

We may use third-party payment processors to process transactions.

You authorize us and our payment providers to charge the payment method you provide for the total amount due, including applicable taxes and shipping charges.

If payment is declined, reversed, disputed, or otherwise fails, we may delay, suspend, or cancel the applicable order.

Placing an order through our website does not necessarily mean that the order has been accepted.

An order confirmation may simply acknowledge that we received your order.

We reserve the right to accept, reject, modify, or cancel an order as permitted by these Terms and applicable law.

Because custom products require materials, labor, design work, production time, and other resources, cancellation rights may differ from those applicable to standard products.

Once work has begun on a custom order, cancellation may not be available or may be subject to a cancellation fee or deduction for work and materials already incurred, to the extent permitted by law.

If a customer requests cancellation before production begins, we will make reasonable efforts to accommodate the request.

However, an order is not considered canceled until KRAFTED DESIGNS confirms the cancellation.

Our return, refund, and exchange procedures are governed by our applicable Return/Refund Policy.

Custom, personalized, or made-to-order products may have different return or cancellation rules because they are produced specifically for an individual customer.

Nothing in these Terms is intended to eliminate any rights or remedies that cannot legally be waived under applicable law.

If you receive an item that is damaged, materially defective, or materially different from what you ordered, please contact us promptly with your order information and photographs or other documentation reasonably necessary to evaluate the issue.

Orders require processing time before they are shipped.

Processing time is the period during which KRAFTED DESIGNS prepares, creates, customizes, packages, and otherwise completes an order before transferring it to a shipping carrier.

Shipping time begins after the order has been processed and shipped.

Estimated delivery dates are estimates and are not guaranteed unless expressly stated otherwise.

Shipping may be delayed by circumstances including:

• USPS delays;
• Weather;
• Holidays;
• High shipping volume;
• Address errors;
• Carrier disruptions;
• Lost or misrouted packages;
• Customs or governmental delays;
• Natural disasters;
• Technical issues;
• Unforeseen production circumstances; or
• Other events outside our reasonable control.

Once an order has been transferred to USPS or another carrier, carrier-controlled delays are outside KRAFTED DESIGNS' direct control.

KRAFTED DESIGNS may use the United States Postal Service ("USPS") and other shipping carriers.

Where tracking is available, we may provide tracking information to the customer.

Tracking information may not immediately update after a package leaves our possession.

A tracking number showing that a package is in transit, delayed, awaiting acceptance, or otherwise moving through the carrier system does not necessarily mean that the package has been lost.

Customers should allow reasonable time for carrier updates and delivery.

Customers are responsible for providing a complete and accurate shipping address.

KRAFTED DESIGNS is not responsible for delays, returned packages, additional shipping charges, or lost packages caused by an incorrect, incomplete, outdated, or improperly entered address supplied by the customer.

If an order is returned to us because of an incorrect or undeliverable address, additional shipping charges may apply before the order is reshipped.

Once a package has been delivered according to carrier tracking information, KRAFTED DESIGNS may consider the order delivered.

If a package is marked delivered but cannot be located, customers should first check with household members, neighbors, building management, mailrooms, and the local carrier facility.

KRAFTED DESIGNS may assist customers in contacting or submitting inquiries to the shipping carrier, but we cannot guarantee the outcome of a carrier investigation.

Where appropriate, customers may be responsible for filing claims with the carrier or applicable insurance provider.

Customers are responsible for following any care instructions provided with their products.

Failure to properly care for a product may result in damage, discoloration, deterioration, or other changes that are not attributable to a manufacturing defect.

Because our products may be handmade and may contain different materials, care requirements may vary by product.

Some products may contain natural, handmade, painted, dyed, printed, sewn, assembled, or otherwise individually processed materials.

Such materials may naturally exhibit variations.

These characteristics may include differences in:

• Color;
• Grain;
• Texture;
• Pattern;
• Shape;
• Thickness;
• Finish; or
• Surface appearance.

Such variations are not necessarily defects.

You agree to use our website only for lawful purposes.

You may not use the website to:

• Violate any applicable law;
• Commit fraud;
• Attempt unauthorized access;
• Interfere with website operations;
• Introduce malicious software;
• Scrape or harvest information in an abusive or unauthorized manner;

You should not submit confidential information that you do not want publicly displayed.

We reserve the right to remove or decline to publish content that we reasonably believe is unlawful, fraudulent, abusive, defamatory, obscene, infringing, misleading, or otherwise inappropriate.

Unless you request otherwise before or at the time of placing your order, KRAFTED DESIGNS may photograph completed products for internal records, quality control, portfolio purposes, website content, social media, advertising, or other legitimate business purposes.

If you do not want your completed custom product photographed or publicly displayed, please contact us before production begins.

We will make reasonable efforts to honor such requests going forward, subject to applicable law and technical limitations.

Our website and business may rely on third-party services, including:

• Payment processors;
• Website-hosting providers;
• E-commerce platforms;
• Shipping carriers;
• Analytics providers;
• Email providers;
• Advertising platforms;
• Social-media platforms; and
• Other service providers.

Your use of third-party services may be subject to those providers' own terms and policies.

KRAFTED DESIGNS is not responsible for the acts, omissions, availability, policies, or performance of third-party providers.

Our website may contain links to third-party websites.

These links are provided for convenience and do not constitute an endorsement or guarantee of the third party.

We do not control third-party websites and are not responsible for their content, security, privacy practices, availability, or terms.

To the maximum extent permitted by applicable law, our website and products are provided on an "as available" and "as is" basis.

We do not guarantee that:

• The website will always be available;
• The website will be error-free;
• Website content will always be complete or accurate;
• Product availability will never change;
• Product colors will appear identical to photographs;
• Shipping estimates will always be accurate;

• Every product will be identical to photographs, samples, or previous orders.

Nothing in these Terms excludes a warranty or legal protection that cannot lawfully be excluded.

To the maximum extent permitted by applicable law, KRAFTED DESIGNS KY LLC and its owners, members, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of our website or purchase or use of our products.

To the maximum extent permitted by law, our total liability arising from a particular transaction will not exceed the amount actually paid by you to KRAFTED DESIGNS for the product or service giving rise to the claim.

This limitation does not apply to liabilities that cannot legally be limited or excluded under applicable law.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless KRAFTED DESIGNS KY LLC and its owners, members, employees, contractors, agents, affiliates, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your violation of these Terms;
• Your misuse of our website;
• Your violation of applicable law;
• Your submitted artwork, photographs, designs, logos, or other content;
• Your infringement of another person's intellectual-property rights;
• Your fraudulent or unauthorized use of a payment method; or
• Your negligent or wrongful conduct.

This provision does not require you to indemnify us for our own conduct where such indemnification is prohibited by law.

KRAFTED DESIGNS will not be responsible for delays or failures caused by circumstances beyond our reasonable control.

Such circumstances may include:

• Natural disasters;
• Severe weather;
• Fire;
• Flood;
• Power outages;
• Internet or technology failures;
• Labor disruptions;
• Government actions;
• Public emergencies;
• Supplier disruptions;
• Shipping-carrier disruptions;
• Material shortages;
• Acts of war;
• Civil unrest; or
• Other circumstances beyond our reasonable control.

We encourage customers to contact us first to attempt to resolve any dispute informally.

Before pursuing formal legal action, you agree to provide KRAFTED DESIGNS with reasonable written notice of the dispute and an opportunity to attempt to resolve it.

Nothing in this section prevents a party from seeking emergency or legally available injunctive relief where appropriate.

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles, except to the extent another jurisdiction's law is required to apply.

Any dispute that is not otherwise resolved may be brought in a court of competent jurisdiction as permitted by applicable law.

Nothing in these Terms is intended to deprive a consumer of rights or protections that cannot legally be waived.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

We may update these Terms from time to time.

When changes are made, we will update the "Last Updated" date at the top of this document.

Your continued use of our website or purchase of products after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

These Terms, together with any applicable Privacy Policy, Shipping Policy, Return/Refund Policy, product-specific policies, and other written agreements expressly incorporated into these Terms, constitute the agreement between you and KRAFTED DESIGNS concerning your use of our website and purchase of our products.

If there is a conflict between these Terms and a separate written agreement specifically applicable to a particular transaction, the more specific agreement will control to the extent of the conflict.
